Discovery Sanctions Ordered Against Delta Air Lines

McCulley McCluer serves as interim Co-Lead Counsel on behalf of the plaintiffs in an antitrust class action pending in the Northern District of Georgia against Delta Air Lines and Airtran Airways for allegedly colluding to impose first bag fees.  On February 3, 2012, the Court ordered that sanctions be imposed against Delta for its discovery misconduct, awarding Plaintiffs certain fees and expenses related to Delta’s failure to timely locate and produce documents.  The Court ordered that discovery against Delta be reopened for four months, and addressed several other miscellaneous discovery matters.  A copy of the Court's decision is available here.
