Agricultural and Environmental LitigationAgricultural and Environmental Litigation

With an office in Oxford, Mississippi and strong ties to the Mississippi Delta, McCulley McCluer routinely counsels producers and other agricultural businesses.

When Bayer CropScience contaminated the domestic long-grain rice rice supply with an experimental genetically engineered strain of rice, McCulley McCluer was the first law firm to file a class action on behalf of Mississippi rice producers. We were then retained by many of the largest producers in the State to protect their interests in this important litigation. After defeating class certification and losing numerous bellwether trials, Bayer agreed to a $750 million settlement. Our clients received millions of dollars as a result of this settlement.

We also have experience in toxic tort and other environmental contamination litigation. Mr. McCulley received his master's in environmental studies and has published an article on Clean Water Act issues.

We continue to represent a wide variety of agricultural claimants—including producers, cotton gins, grain elevators, and flying services—in pursuing claims in the BP Oil Spill Settlement Program. Many of our clients have qualified for the settlement and are likely to receive substantial payments.
